God's chosen one is on the loose

Remember psychic judge Florentino Floro? He was booted out of office by the Supreme Court. Apparently, he's now hunting down those who wrote and blogged about him. God is for Suckers just received an email from Judge ESP. Here's a snippet:

I never used the word DWARVES in any DECISION, and I never consulted any imaginary dwarf to pen my decisions, my detractors submitted these false evidence or lies; and what I do believed in is: in the so-called SPIRIT GUIDES or PROTECTORS. LUIS, is the KING OF ALL KINGS of ELEMENTALS/spirits worldwide; and he is GOD’s ANGEL (Genesis, Exodus, etc.) What I believe in, is what St. Paul teaches: Gifts of the Holy Spirit, Prophecy and Spiritual Healing. I am GIFTED, and I never tried to develop my psychic powers, since what I believe in, is God’s GIFT to me of these — TO HEAL and TO PROPHESY, I never used these in DECISIONS.

I am not psychotic, and if you read the DECISION, it RULED that I can apply in other government positions that do not require dispensation of justice. I am a victim of INJUSTICE. On September 19, 1995, I stated that Atty. Teresita Cruz-Sison (Judicial and Bar Council Member) would suffer massive STROKE. HER VENGEANCE resulted in the submitting of FALSE EVIDENCE about DWARFS, ANGELS, PSYCHIC PHENOMENA, etc. Here in the Philippines, Judges, Justices are first NOMINATED by the Judicial and Bar Council (who selects 3) and the President of the Philippines appoints a Judge or Justice based on these 3 submissions.

I admit that GOD has chosen me to be the instrument to CLEAN the Philippine Supreme Court and Judiciary of CORRUPTION and abuse of power — by inflicting illnesses....

...

IN SUM, KARMA and the CURSE as we Catholics and Christians believe in have their own ways in revealing the truth; my clerk of court, Atty. Esmeralda G. Dizon, who submitted false evidence about dwarfs and psychic phenomena, to make it appear that I have brain damage, now, her first born, GELAY, 10 years old was inflicted with EPILEPSY, with 2x a week severe attacks. I admit that my GUIDE LUIS did all these, to impress upon the Philippine Judiciary, that receiving BRIBE money and abuse of powers, due to lust for glory, cannot remain unpunished in the laws of these UNSEEN, that are more REAL than we ever imagine. I REPEAT, LUIS, ARMAND AND ANGEL ARE NOT THE LOWLY DWARVES OR GNOMNES BUT SPIRIT GUIDES AND PROTECTORS THAT GOD HAD CHOSES AS INSTRUMENTS TO RID THE PHILIPPINE JUDICIARY OF MISFITS AND ROTTEN EGGS, THOSE THAT FAIL TO DELIVER IMPARTIAL JUSTICE BECAUSE OF MONEY, GREASE OR GRAFT MONEY.

Nuts, man. Plain nuts.

The brain creates supernaturalism.
Supernaturalism screws up the brain.

Hey, wait a minute. I wrote about this woowoo. Why hasn't he spammed me yet? No fair!

Stare Decisis in Constitutional Law
“Judges and justices are servants of the law, not the other way around. Judges are like umpires. Umpires don't make the rules; they apply them. The role of an umpire and a judge is critical. They make sure everybody plays by the rules. But it is a limited role. Nobody ever went to a ball game to see the umpire. Judges have to have the humility to recognize that they operate within a system of precedent, shaped by other judges equally striving to live up to the judicial oath. And judges have to have the modesty to be open in the decisional process to the considered views of their colleagues on the bench.”
- Chief Justice John Glover Roberts, Jr. -
[Opening statement before the Senate Judiciary Committee, as transcribed by CQ Transcriptions: September 12, 2005].

Respondent Judge FLORENTINO V. FLORO, JR., [Presiding Judge, Br. 73, RTC, Malabon/Navotas, NCJR], unto this Honorable Court, by himself, and by the undersigned attorney (ad Hoc, in collaboration with his counsel of record, Atty. Gregorio M. Batiller, Jr.) under oath, hereby deposes and respectfully states, that:
1. President Bush said before John Paul Stevens, the Acting Chief Justice, administered the oath of office: “The Senate has confirmed a man with an astute mind and kind heart. All Americans can be confident that the 17th chief justice of the United States will be prudent in exercising judicial power, firm in defending judicial independence and, above all, a faithful guardian of the Constitution.”(FOXNEWS.COM HOME, September 30, 2005).

2. Respondent Judge Floro humbly begs this 21st Panganiban Court to compassionately REINSTATE him based on the same jurisprudence / STARE DECISIS that Your Honors’ predecessors’ --- the 19th Narvasa and 20th Davide Courts --- used in CAGIGAL & MURO and VILLEGAS, respectively; in these 2 and 1 REINSTATEMENTS of dismissed Judges, Judge Floro ardently believes that by FAITH (that does Justice), this 21st Court (that barely has TIME, for it will bow on December 9, 2006, or 215 days from this 5th First Friday) is PRE-DESTINED to REINSTATE at the very least, ONE Judge; we fervently appeal that the 21st Chief Justice, as a FINAL FEATHER on his cap, bestow upon the herein unfortunate respondent, the same extraordinary RESOLUTIONS that the NARVASA & DAVIDE Courts did benignly GRANT upon the 3 dismissed RTC Judges.

3. We cite the 17th Chief Justice’s of the United States ponencia:
Stare Decisis in Constitutional Law ---
“Adherence to precedent ordinarily limits and shapes the approach of courts to decision of a presented question. Stare decisis is usually the wise policy, because in most matters it is more important that the applicable rule of law be settled than that it be settled right. . . . This is commonly true even where the error is a matter of serious concern. Stare decisis is a principle of policy.”
“The common denominator of all these maxims of prudence is the concept of judicial restraint, of judge's restraint. ''We do not sit”, said Justice Frankfurter, ''like kadi under a tree, dispensing justice according to considerations of individual expediency”. “[A] jurist is not to innovate at pleasure,” wrote Justice Cardozo. ''He is not a knight-errant, roaming at will in pursuit of his own ideal of beauty or of goodness. He is to draw his inspiration from consecrated principles. He is not to yield to spasmodic sentiment, to vague and unregulated benevolence. He is to exercise a discretion informed by tradition, methodized by analogy, disciplined by system, and subordinated to the primordial necessity of order in the social life.”

4. In the light of the cited secondary authority, respondent Judge Floro hereby anchors his hypothesis on the very same jurisprudence and ground rules Your Honors have cited. With due respect, please allow the herein respondent to make the following observations:
Nature of Proceedings for Removal of Judicial Officers

a) As early as 1893, it was ruled that:
“an impeachment proceeding for removal of judges is of judicial and criminal in nature and is governed by the rules applicable to criminal cases. The charge must, therefore, be proved beyond reasonable doubt.”

[48 C.J.S. 27, p. 975; citing Ala.- State v. Hasty, 63 So. 559m 184 Ala. 121; State v. Hastings, 37 Neb., 96).

b) The States Supreme Courts promulgated the case law, that:
“The removal of a judicial officer is a matter usually regulated by the constitution or statutes, and removal proceedings must be in strict accordance with such provisions.”
[Mont. – State ex rel. Ryan v. Norby, 165 P.2d 302; Ind. – State v. Dearth, 165 N.E. 489, 201 Ind. 1; Okl. – State v. Rowe, 300 P. 727, 149 Okl. 240].
c) In this jurisdiction, as early as 1922, Justice Malcom, in the case of In Re Horilleno (43 Phil. 212) declared that: “The grounds for removal of a judge of first instance under Philippine law xxx xxx the quantum of proof to establish the cause of removal must be proof beyond reasonable doubt.”

d) In the recent case of Lachica (February 28,2006), Madame Justice Ynares-Santiago cogently stressed --- it is now settled that before a judge is removed from office, the charges must be proved beyond reasonable doubt:
“In its attempt to cleanse the Aegean stables, so to speak, this Court must tread on with utmost circumspection and prudence to make sure that only the guilty is denounced and the innocent absolved. It must be stressed in this regard that xxx, the general rules as to admissibility of evidence in criminal trials apply and the culpability of the respondent should be established beyond reasonable doubt.

Thus, as in criminal cases where the dictates of due process is observed with utmost stringence, the respondent judge in this administrative complaint should likewise be given full opportunity upon reasonable notice to defend herself and to adduce evidence in support thereof for the Court will not allow itself to be an instrument that would destroy the reputation of any member of the bench by pronouncing guilt on the basis of incomplete evidence or mere speculation.”

[Cea v. Paguio, 445 Phil. 533, 537 (2003).; Araos v. Luna-Pison, supra at 296; See Bustamante-Alejandro v. Alejandro, A.C. No. 4256, February 13, 2004, 422 SCRA 527, 533. Ong v. Rosete, A.M. No. MTJ-04-1538, October 22, 2004, 441 SCRA 150, 161].

[A.M. No. MTJ-05-1609, LACHICA vs. JUDGE R. M. TORMIS, February 28, 2006].

5. THE CONSTITUTIONAL COMMISSION OF 1986’s Mr. Concepcion and Fr. Bernas (with 29 others) defeated the proposal of Mr. De Castro to insert a comma (,) and the amendment regarding the procedure to determine incapacity of judges; Mr. De Castro desperately fought for the insertion of the words “AS DETERMINED BY THE GOVERNMENT PHYSICIAN CHOSEN BY THE SUPREME COURT”; but he only got 1 other vote: 2 vs. 31 (against his proposed amendment).
6. Verily, as stressed by Mr. Concepcion, upon interpellation by Fr. Bernas, a) an enabling law may be passed, or b) the JBC may be consulted by the High Tribunal; but in any case, Mr. Concepcion WON: the judge’s medical incapacity is “determined by a c) COMMITTEE OF DOCTORS created by the Supreme Court. xxx. The court has deemed it best to choose in every case the DOCTORS who shall probably determine the INCAPACITY of a member or judge to d) INSURE IMPARTIALITY” (1 Rec. 495-6). Applying the foregoing clear INTENT of the 1987 CONSTITUTION’S FRAMERS, respondent Judge Floro begs this Court to set aside, due to clear impression of NULLITY, the said March 7, 2001 findings of the mental health professionals who interviewed/analyzed him: Dr. Rosa Mendoza is a general physician; Dr Celeste Vista, although a psychiatrist, is a government physician who is not an IMPARTIAL DOCTOR (part of the PANEL OF DOCTORS, that must be created by the High Tribunal); Ms. Sanchez & Ms. Cruz are mere psychologists.
Mr. Concepcion made a very important remark and answer upon interpellation by Fr. Bernas: that the JBC may be consulted on the matter of incapacity of incumbent judges, since: a) the Constitution places it under title VIII (Judicial Department), b) the Supreme Court has supervision over it, and c) it conducts mental tests upon applicants to judicial posts before nomination.

7. As primary source of authority to interpret the cited constitutional provisions on the power, procedure and correct proceeding to determine the incapacity of a judge, we REPRODUCE NEXT PAGES the pertinent parts of the Record and the Journal.
8. II. Judge Manuel T. Muro, December 11, 2006 REINSTATEMENT

9. Like Judge Muro (who was reinstated on 11 December, 1995, 251 Scra 111), Judge Floro hereby renews his pledge and sincerely attests to his unsullied name and service records as lawyer and judge prior to this administrative case; with all sincerity Judge Floro hereunder writes a humble and contrite gesture by making a --- Solemn Commitment ---
a) that he will avoid creating a situation that spawns suspicion of arbitrary and improper conduct; that he would adopt usual and expected method of doing justice and not seek to be extreme or peculiar in his judgment or spectacular or sensational in the conduct of the court; and
b) that he would avoid all appearances of impropriety, specially those that create suspicion of partiality, bias or improper motive; and more specifically, he would avoid any public expression of his religious beliefs in St. Paul’s teachings of GIFTS of the Holy Spirit, that is, prophecy and spiritual healing, he would avoid any expression of his belief in the paranormal, psychic phenomena, angel of death, punishment due to karma, curse, inflicting of illnesses, predictions and prophesy of downfall of Erap or of any other political or judicial event; (Canon of Judicial Ethics, par. 17, 19, and 3, Canon 2).
10. In this regard also, Judge Floro takes refuge in the 21st Chief Justice’s immortal words regarding the subject freedom in the Bill of Rights:
“xxx perseverance of this Court in safeguarding the people’s constitutionally enshrined liberty. Worse, our people will surely condemn the misuse of legal hocus pocus to justify this trifling with constitutional sanctities.”

11. In line with the pronouncement of the 18th FERNAN Court in the “In re: Petition for Dismissal from Service of Judge Baltazar R. DIZON” case, and borrowing the words therein, the Decision to dismiss herein respondent took effect on March 31, 2006 and released on April 6, 2006.
III. Judge FRANKLYN A. VILLEGAS, November 18, 2004 REINSTATEMENT
12. Like Judge Villegas, respondent Judge Floro borrows his words, as herein respondent humbly begs this 21st Court “to reconsider the decision in the spirit of the doctrine of STARE DECISIS … thus:
Respondent anchors his hypothesis on the very same jurisprudence Your Honors’ have cited. With due respect, please allow the herein respondent to make the following observations:
(a) In Davila vs. Generoso, [336 SCRA 576, 580 (200), citing Longboan vs. Polig, 186 SCRA 557, 561, (1990), the respondent Judge therein was required to comply the directives of the Honorable Court’s directives, particularly in the cited Resolutions therein, more specifically, Resolution dated January 21, 1998, requiring him to show cause why he should not be dealt with disciplinarily or held in contempt for failure to comment on subject complaint of complainant Davila and to comply with the resolution of August 13, 1997, within ten (10) days from notice. The same was followed with a Resolution dated October 5, 1998, wherein the respondent judge was required to comply with the resolution of January 21, 1998, within ten (10) days from notice, under pain of appropriate disciplinary action, yet, he was still afforded one last chance and finally in a Resolution dated March 17, 1999, the respondent was required to show cause why he should not be dealt with more severely for failure to comply with the Resolution, dated December 11, 1995, and to file the required comment within ten (10) days from notice.
It is most respectfully noted that there were at least three (3) warnings given the respondent before he was finally handed the verdict of dismissal from service.
(b) In Parane vs. Relosa, [238 SCRA 1, (1994)], the respondent likewise failed to heed the Honorable Court’s directives and in the Resolution of August 4, 1994, the Court, wishing to afford respondent Judge another opportunity to explain himself, resolve thusly:
“WHEREFORE, finding respondent Judge guilty of gross misconduct and insubordination in his continued failure to comply with the lawful orders of this Court, the Court hereby IMPOSES on the respondent Judge a FINE of Five Thousand Pesos (P5,000,00). Said respondent is still required to COMPLY with the resolution of 22 July 1993 within ten (10) days from receipt hereof, with a STERN WARNING that non-compliance therewith will be dealt with most severely as so herein above expressed. x x x”
With respondent’s continued defiance of the last Court directive, he was ultimately dismissed from the service on November 7, 1994. It is further noted that the respondent was afforded his final chance before the extreme penalty of dismissal from the service was handed down.
(c) In the case of Guerrero vs. Deray [A.M. No. MTJ-02-1466, 10 Dec. 2002, citing Joseph vs. Abarquez, 261 SCRA 629 (1996), the respondent was found guilty of gross incompetence and inefficiency, gross misconduct and conduct prejudicial to the best interest of the service.
The Honorable Court has meted upon the respondent the extreme penalty of dismissal because it was warranted by the circumstances, when it said: “In other words, indifference or defiance to the Court’s orders or Resolutions may be punished with dismissal, suspension or fine as warranted by the circumstances.”
(d) In the case of Erlinda Alonto-Frayna vs. Judge Abdulmajid J. Astih [300 SCRA 199 (1998)], The Honorable Court found the respondent guilty of gross inefficiency and neglect of duty exacerbated by his audacious stance in defying the Court’s orders.”

13. Because of Stare Decisis, and more importantly, since the 20th Davide Court wanted to be the same as its predecessor, the 19th Narvasa Reinstatement Court, C.J. Davide, with COMPASSION that does JUSTICE, tersely WROTE the destiny of Judge VILLEGAS, citing precedents of clemency, mercy and compassion upon Judges:
In administrative cases involving discipline of judges and court personnel, we have allowed second or even third motions for reconsideration
“In our En Banc decision of 03 February 2004 in A.M. No. 03-1515-MTJ (Dolores Imbang vs. Judge Deogracias del Rosario, MCTC Patnongon, Bugasong, Valderama, Antique), we meted the penalty of fine of P10,000 on respondent Judge for his failure to comply with many directives of the Office of the Court Administrator requiring him to file a comment on the Complaint and for failure to immediately resolve pending motions and to decide a case within the 90-day period, which constituted gross inefficiency. In that case the complaint was filed on 31 July 1998 yet. Judge Del Rosario was required to comment thereon by the OCA in its 1st Indorsement of 9 February 1999, but Judge Del Rosario did not comply with it despite several subsequent letters from the OCA, forcing the OCA to report the matter to the Court and to recommend that Judge Del Rosario be fined in the amount of P5,000 “for his obdurate defiance of the several directives of the Office of the Court Administrator”; considered to have waived his right to defend himself in said case; and be fined P2,000 for delaying the administration of justice by failing to decide Civil Case No. 318 entitled Dolores Imbang vs. Alice Guerra.
In the del Rosario case, despite our conclusion that Judge Del Rosario’s “failure to comply with the Court’s directive to file his comment to the letter complaint against him constitutes a blatant display of his indifference to the lawful directives of the Court” and “gross misconduct and insubordination;” and his prior convictions in two administrative cases, we merely imposed upon him a fine of P10,000. He was further directed to show cause within 10 days from notice why he should not be dismissed from the service for his refusal to file his Comment as directed by the Court.
While indeed a second motion for reconsideration is a prohibited pleading under the 1997 Rules of Civil Procedure, we have allowed it in certain cases. Besides, in administrative cases involving discipline of judges and court personnel, we have allowed second or even third motions for reconsideration whenever justified by the circumstances. In the instant case, and taking the foregoing observations, we have resolved to give due course to the second motion for reconsideration and to partly grant the relief prayed for. The penalty of dismissal from the service which we have imposed on respondent may seem, indeed, to be harsh. There were administrative cases of more serious nature where we have been less harsh. (Zarate vs. Judge Balderian, (A.M. No. MTJ-00-1261, 3 April 2000; 386 Phil. 1); Guintu vs. Judge Lucero, (A.M. MTJ-93-794, 23 August 1996, 329 Phil. 704). Only last 10 September 2004, in Tamondong vs. Judge Marino de la Cruz, (A.M. No. 00-1-10-RTC) we merely imposed a fine of P40,000, despite the finding of “repeatedly failing to heed the Court’s show cause orders, as well as the lawful directives of the OCA.”
WHEREFORE, in light of the foregoing, the Second Motion for Reconsideration of respondent is hereby given due course, and is partly granted. The penalty of dismissal from the service imposed on respondent is hereby REDUCED to suspension for a period reckoned from the time respondent received a copy of the decision of 19 November 2003 until he shall re-assume office by virtue of this Resolution, which he must do within ten (10) days from notice of this Resolution. Respondent is further directed to pay, within thirty (30) days from notice of this Resolution, a fine of P50,000.
SO ORDERED. xxx.”
[EN BANC, A.M. No. RTJ-03-1812. November 18, 2004, PABLITO R. SORIA, ET AL., complainants, vs. JUDGE FRANKLYN A. VILLEGAS, Regional Trial Court of Pagadian City, Branch 19, respondent, R E S O L U T I O N, DAVIDE, JR., C.J.]
III.a. Judge Philbert I. Iturralde, August 31, 2000 Lifting of Preventive Suspension and November 21, 2000 Full REINSTATEMENT
14. Respondent Judge Floro also cites, with due respect:
“Respondent Judge Iturralde
What complainant Federico Calilung said in his sworn statement (Exhibit A) that respondent Judge Suriaga assured him (Calilung) there would be no problem in the case on appeal because Judge Iturralde himself assured him (Suriaga) of a favorable decision in consideration of the amount of P250,000.00, to which he (Iturralde) agreed, is “totally hearsay and not true”. Federico Calilung’s testimony that although he was not able to talk to Judge Iturralde himself, it was his lawyer, Atty. Marlon Lauder, who did regarding the case on appeal and Judge Iturralde said he should talk to Judge Suriaga instead because they had already come to an agreement regarding the matter, is again “totally hearsay and not true.” What the Calilungs swore in their affidavit dated April 20, 1999, that Judge Suriaga instructed them to prepare the money and told them there was no problem in the appeal as Judge Iturralde has assured them of a favorable decision and about the scheduled pay-off on April 19, 1999 at his rented house where Judge Iturralde would receive the money, is likewise “totally hearsay and not true. So is the alleged telephone call by Judge Suriaga insinuating that he (respondent Judge Iturralde) was at the other end of the line, is “totally hearsay and not true.” At 1:35 in the afternoon of April 19, he was in his sala conducting a hearing as scheduled in the calendar for that day starting from about 1:30 o’clock in afternoon and ending at about 4:00 o’clock p.m. [152] He was supposed to hear twelve cases for that day starting from 1:30 o’clock. He arrived at his sala about 12:30 o’clock noon, took his lunch and went over the record of the cases involved. He received no telephone call from anybody that afternoon of April 12, 1999 while in Court in Angeles City. He inquired from the members of his staff if they received any for him and they told him there was none. The joint affidavit of his staff members to that effect is marked Exhibit 6. The calendar of cases set for hearing on April 19, 1999 is marked Exhibits 7, 7-A and 7-B. He then left to fetch his wife at the Veterans Memorial Hospital near Shoemart at EDSA in Quezon City. He reported for work next day, April 20, and until Friday of that week. He went on leave of absence beginning April 27, 1999, the application therefor he filed on March 25, duplicate copy of which is marked Exhibit 8. He tried once at the driving range but his back ached. He has a set of golf clubs which he bought “hulugan.” The medical certificate attesting to his health is marked Exhibit 10. It is not true he was supposed to go to Judge Suriaga’s house in Angeles City on April 19, 1999. That is totally hearsay and not true.
On the basis of the foregoing evidence, the Investigator, (Ret.) Justice Pedro A. Ramirez recommended the dismissal of both respondents with the forfeiture of benefits except accrued leaves.
As regards the case against Judge Iturralde, complainants capitalized on a telephone conversation that allegedly transpired in the house of Judge Suriaga on April 19, 1999, the date the latter was entrapped and arrested. There being no sufficient showing at this time to establish the culpability of Judge Iturralde, the case against him should be referred back to the Office of the Court Administrator for further investigation as to his participation in the anomalous transactions complained of. In the meantime, in order to enable Judge Iturralde to perform his functions, this Court lifts his suspension pending the proceedings against him.
WHEREFORE, in view of all the foregoing, judgment is hereby rendered:
1.] Respondent Wilfredo S. Suriaga is DISMISSED from the xxxz 2.] The administrative complaint against respondent Philbert I. Iturralde is REFERRED back to the Office of the Court Administrator for further investigation. In the meantime, his preventive suspension is hereby LIFTED.
SO ORDERED.”
[EN BANC, A.M. No. RTJ-99-1437. August 31, 2000, FEDERICO S. CALILUNG, complainant, vs. JUDGE PHILBERT I. ITURRALDE, RTC, Branch 58, Angeles City, respondent, PER CURIAM]
15. Judge Iturralde was exonerated and fully reinstated, thus:
“Concededly, administrative proceedings are not strictly bound by formal rules on evidence. However, the liberality of procedure in administrative actions is still subject to limitations imposed by the fundamental requirements of due process. Thus, the old but still very much applicable and oft-quoted case of Ang Tibay v. CIR 69 Phil. 635 [1940].states that "{t}his assurance of a desirable flexibility in administrative procedure does not go so far as to justify orders without a basis in evidence having rational probative force." In short, mere uncorroborated hearsay or rumor does not constitute substantial evidence. GSIS v. CA, 296 SCRA 514 [1998], citing Ang Tibay v. CIR, supra., citing Consolidated Edison Co.v.National Labor Relations Board, 59 S. Ct. 206, 83 Law ed. No. 4, Adv. Opp., p. .Indeed —
The Rules, even in an administrative case, demand that, if the respondent judge should be disciplined for grave misconduct or any graver offense, the evidence against him should be competent and should be derived from direct knowledge. 36 Raquiza v. Castaneda, Jr. 81 SCRA 235 [1978].The Judiciary to which the respondent belongs demands no less. Before any of its members could be faulted, it should only be after due investigation and after the presentation of competent evidence, especially since the charge is penal in character. OCA v. Judge Filomeno Pascual, 259 SCRA 604 [1996], citing Raquiza v. Castaneda, supra.
Misconduct is defined as any unlawful conduct on the part of a person concerned in the administration of justice prejudicial to the rights of parties or to the right determination of the cause. Canson v. Garchitorena, SB-99-9-J, 28 July 1999, 311 SCRA 268, citing Black’s Law Dictionary, Fourth ed., p. 1150.It generally means wrongful, improper or unlawful conduct motivated by a premeditated, obstinate or intentional purpose. Ibid., p. 285, citing Words and Phrases, Vol. 27, p. 466, citing Sewell v. Sharp, La App., 102 So 2d 259,261.The definition, however, can hardly apply to respondent Iturralde since the record is bereft of any persuasive showing of a wrongful, improper or unlawful conduct on his part. What, in fact, appears on record is at most an indictment for an alleged illegal act yet to be performed and to be confirmed during the April 19, 1999 entrapment operation which never materialized.
In this regard the Court finds it useful to reiterate the ruling in Raquiza v. Castaneda, Jr., See note 196.which held that -
The ground for the removal of a judicial officer should be established beyond reasonable doubt. Such is the rule where the charges on which the removal is sought is misconduct in office, willful neglect, corruption, incompetency, etc. The general rules in regard to admissibility in evidence in criminal trials apply.
Succinctly stated, this Court can not give credence to charges based on mere suspicion and speculation. Lambino V. De Vera, 275 SCRA 60 [1997].Apropos in closing is the pointed observation of Mr. Justice Josue N. Bellosillo in his dissenting opinion in State Prosecutors v. Muro 236 SCRA 505, 544 [1994]. that -
…[w]hile this Court may slightly bend backwards if only to avoid the suspicion of partiality and cliquism to a brother in the profession, it must also step forward and take the lead to defend him against unsubstantiated tirades which put to shame and disgrace not only the magistrate on trial but the entire judicial system as well. As champion - at other times tormentor - of trial and appellate judges, this Court must be unrelenting in weeding the judiciary of unscrupulous judges, but it must also be quick in dismissing administrative complaints which serve no other purpose than to harass them. In dismissing judges from the service, the Court must be circumspect and deliberate, lest it penalizes them for exercising their independent judgments handed down in good faith.
WHEREFORE, in view of all the foregoing, judgment is hereby rendered:
1.] DENYING the motion for reconsideration of respondent Wilfredo S. Suriaga; and 2.] DISMISSING the administrative complaint against respondent Philbert I. Iturralde for insufficiency of evidence.
Concomitantly, respondent Judge Iturralde is entitled to backwages and other benefits which accrued during his preventive suspension, and the same are hereby ordered released to him.”
[A.M. No. MTJ-99-1191. November 21, 2000, FEDERICO S. CALILUNG vs. JUDGE WILFREDO S. SURIAGA, EN BANC]
THE DECISION / JUDGE FLORO: TRULY UNPRECEDENTED INTERNATIONAL MEDIA (WEBSITES, INTERNET) REPORTS, WORLDWIDE OUTPOURING OF SYMPATHY; TRANSCENDENTAL IMPORTANCE, SIGNIFICANCE, RECOGNITION AND ACKNOWLEDGMENT OF THE DECISION / JUDGE FLORO, IN THE GLOBAL DEPARTMENTS OF a) LAW, b) JUDICIARY, c) HEADLINE NEWS-REPORTS (BLOGS, WEBSITES) AND d) PARAPSYCHOLOGY, P S I (PSYCHIC PHENOMENA) --- REUTERS, AFP, ASSOCIATED PRESS, FOREIGN / LOCAL PRESS, & BROADCAST / PRINT MEDIA.
16. Judge Floro again BORROWS the words of Judge Muro: the 20th Davide Court, Per Curiam, succinctly stated, that --- “xxx certain matters and TURN OF EVENTS since the filing of respondent’s motion for reconsideration STIR THE COURT to UNDERTAKE a RE-EXAMINATION of the PENALTY of DISMISSAL (in the case at bar, a non-penalty of SEPARATION FROM SERVICE) originally imposed upon him. xxx. These indeed are FAVORABLE considerations warranting the commutation of respondent’s penalty of dismissal, if only to GIVE him the CHANCE to REDEEM himself from an error of this magnitude which he committed only for the first time. AFTER ALL, this Court is NOT BEREFT of COMPASSION and MERCY.”

17. Accordingly, and at this juncture, Judge Floro cites 2 jurisprudence on JUDICIAL NOTICE of COLLECTIVE Newspaper Reports that may trigger administrative cases, and logically, with due respect, the MAGNITUDE thereof, is submitted to affect therefore, the Court’s kind understanding in the application of STARE DECISIS:
“Such is this administrative charge triggered by newspaper accounts which appeared on the 21 July 2000 issues of The Manila Standard, The Manila Times, Malaya, The Philippine Daily Inquirer and Today. The national dailies collectively reported that Court of Appeals Associate Justice Demetrio G. Demetria tried to intercede on behalf of suspected Chinese drug queen Yu Yuk Lai, alias Sze Yuk Lai, who went in and out of prison to play in a Manila casino.”
[EN BANC, A.M. No. 00-7-09-CA. March 27, 2001, In Re: Derogatory news Items Charging Court of Appeals Associate Justice Demetrio Demetria with Interference on Behalf of a Suspected Drug Queen: Court of Appeals Associate Justice Demetrio G. Demetria,, PER CURIAM].
“Judicial notice is the cognizance of certain facts which judges may properly take and act on without proof because they already know them. Under the Rules of Court, judicial notice may either be mandatory or discretionary. Section 2 of Rule 129 enumerates the instances when courts may take discretionary judicial notice of facts -
SEC. 2. Judicial notice, when discretionary. - A court may take judicial notice of matters which are of public knowledge, or are capable of unquestionable demonstration or ought to be known to judges because of their judicial functions.”
[G.R. Nos. 135695-96. October 12, 2000, PEOPLE OF THE PHILIPPINES, plaintiff-appellee, vs. TOMAS TUNDAG, accused-appellant, QUISUMBING, J.].
18. Fr. Joaquin G. Bernas, S.J., (in his AUTHOR’S FOREWORD, February 24, 1974, to his “The 1973 Philippine CONSTITUTION”) opined that the hardest case in P.I. History is the 338 pages JAVELLANA vs. EXECUTIVE SECRETARY, 50 Scra 30 (1973) because of the highly divided vote and the fact that it is the longest Decision ever penned. He might be correct, if the twin ingredients would be the basis. However, if the MAGNITUDE of acknowledgment by the global community would be, then, the instant case penned by Madame Justice MINITA VIRAY CHICO-NAZARIO would never be duplicated, much less surpassed by JAVELLANA: without FEAR, we humbly submit, that in P.I. judicial History, the instant case is not only the HARDEST, but the most sensational, most reported internationally simultaneously, not once, but daily, and twice ---- circa April 7 and circa May 4, 2006.

19. Fr. Bernas, the “guru of destabilization” (as he was baptized by media), added that “many could not and would not believe the news; some asked the Supreme Court to say that the 1973 Constitution was not in force and effect”. He cogently stressed, that at the bottom of all these, is the degree of one’s FAITH … thus, he dedicated his book for BELIEVERS and infidels alike ... In like manner, Judge Floro humbly begs this 21st Court to “BENIGNLY RE-EXAMINE the Ponente’s Decision of Separation from Service” in view of the TRANSCENDENTAL IMPORTANCE of the RULING upon the DEPARTMENTS of LAW, CONSTITUTION, JUDGES, STARE DECISIS, PARAPSYCHOLOGY and PSI, inter alia.

20. Judge Floro will never be forgotten in World Judicial (Constitution and RULE OF LAW) and Parapsychological (PSI) history. With due respect and HUMILITY, even if the local media LAMBASTED us, and even if all the tabloids cast aspersion upon herein unfortunate respondent, as PSYCHOTIC, the International Reports, inter alia, placed him in their chronicles. NEVER in World Judicial History had a DECISION / Judge been so REPORTED with MAGNITUDE, with SYMPATHY, with fair CRITICISM, and with peppered COMMENTS worldwide. NEVER was a JURIST written in almost all PAPERS/websites/BLOGS --- REUTERS, ASSOCIATED PRESS, AFP, etc.

Fortune-telling judge couldn't see it coming

May 3, 9:10 AM (ET)
MANILA (Reuters) - A Philippine judge who claimed he could see into the future and admitted consulting imaginary mystic dwarfs has asked for his job back after being fired by the country's Supreme Court.
"They should not have dismissed me for what I believed," Florentino Floro, a trial judge in the capital's Malabon northern suburb, told reporters after filing his appeal.
Floro was sacked last month and fined 40,000 pesos ($780) after a three-year investigation found he was incompetent, had shown bias in a case he was trying and had criticized court procedure, a ruling showed.
He told investigators that three mystic dwarfs -- Armand, Luis and Angel -- helped him carry out healing sessions during breaks in his chambers.
The Supreme Court said it was not within its expertise to conclude that Floro was insane, but agreed with the court clinic's finding that he was suffering from psychosis.

“Psychic” judge sacked after psychiatric report finds him incapable

By ASSOCIATED PRESS
April 7, 2006
MANILA, Philippines (AP) - A Philippine judge who claims to possess supernatural powers, including the ability to see into the future, apparently hasn't mastered those forces _ he failed to foresee his own dismissal.

The Supreme Court said Friday it sacked Judge Florentino Floro, who worked in the Manila suburb of Malabon, after psychiatric and psychological tests concluded he was not fit for the job.

Floro, who told a courtroom that he has psychic visions, also claimed he can appear in two places at once and is able to inflict pain on corrupt officials using his paranormal powers, the Supreme Court said in a statement.

It said Floro admitted he believes in duwendes _ a Tagalog word that means mystic dwarfs _ and that he has a convenant with his "dwarf friends Luis, Armand and Angel."

He also held "healing sessions" in his chambers and claimed he was so powerful he could perform his duties, including writing, while in a trance.
"His mental problems, for now, appear to render him unfit for the delicate task of dispensing justice, not because of any acts of corruption and debasement on his part, but clearly due to a medically disabling condition," the Supreme Court said in its decision.

Nonetheless, the psychological and psychiatric reports used to determine Floro's mental impairment do not disqualify him from re-entering government service, although he is barred from dispensing justice, the court said.

It said those reports found Floro to be equipped with analytical power and that his "character traits of suspiciousness, seclusiveness, preoccupation with paranormal and psychic phenomena ... (are) not detrimental to his role as a lawyer."

The court began to investigate the judge in 1999 after an administrative court audit team recommended he be subjected to psychiatric examination, and after a complaint from the mother of a plaintiff in a frustrated homicide case that Floro dismissed.

The court awarded him three years in back salary and allowances because "his separation from the service is not a penalty as we ordinarily understand the word to mean."

Judge Florentino Floro, who presided in a suburban Manila court, allegedly said he was empowered with supernatural abilities, could read the future and conducted "healing sessions" in his chambers.
"His mental problems for now appear to render him unfit with the delicate task of dispensing justice," the Supreme Court said in a ruling, stressing that Floro had not been found guilty of misconduct or corruption.
Floro, who was said to start his court sessions with a reading from the bible's Book of Revelation, was relieved of his post on administrative grounds but not disbarred or charged with any criminal offense.

Judge gets sacked for having dwarf friends
Published: Saturday, 8 April, 2006, 09:36 AM Doha Time

MANILA: A Philippines judge has been sacked from his post for having dwarfs as friends and for claiming that he has psychic powers, court records showed yesterday.
In a 72-page ruling, the Supreme Court voted unanimously to relieve Florentino Floro of his post as presiding judge in the suburban city of Malabon in metro Manila for being mentally unfit to discharge his duties.
Floro confessed to the Office of the Court Administrator that he has dwarf friends named Armand, Luis and Angel, and that he conducts healing sessions in his chamber during his break time.
Floro also claimed to be endowed with psychic powers and ability to inflict pain and sickness on people.
The high court said that while it was not within its authority to conclude that Floro is “insane,” it agreed with the findings of the Supreme Court clinic that the judge was suffering from psychosis. – DPA

Sacked judge in appeal

A REGIONAL Trial Court (RTC) judge in Malabon who was relieved by the Supreme Court over his mental condition has asked to be reinstated.
Judge Florentino Floro Jr of Malabon RTC Branch 73 also sought the disqualification of the six doctors who declared him mentally impaired after he admitted that he is gifted with psychic powers and is a friend to three dwarves.
According to the judge, the amended Rules of Court never included “weirdness, healing, psychic phenomena and the like as grounds for discipline”.
However, the Supreme Court said, psychic phenomena, even assuming such exist, have no place in a judiciary, which is bound to apply only positive law.

Mystic Dwarfs and Judicial Review At last we have an explanation for one of the great mysteries of American constitutional law. From MSN.com:
MANILA, The Philippines - A Philippine judge who claimed he could see into the future and admitted consulting imaginary mystic dwarfs has asked for his job back after being sacked by the country’s Supreme Court.
“They should not have dismissed me for what I believed,” Florentino Floro, a trial judge in the capital’s Malabon northern suburb, told reporters after filing his appeal.
Floro was sacked last month and fined $780 (40,000 pesos) after a three-year investigation found he was incompetent, had shown bias in a case he was trying and had criticized court procedure, a ruling showed.
He told investigators that three mystic dwarfs -- Armand, Luis and Angel -- helped him carry out healing sessions during breaks in his chambers.
The Supreme Court said it was not within its expertise to conclude that Floro was insane, but agreed with the court clinic’s finding that he was suffering from psychosis.
Now consider the following language from Griswold v. Connecticut:
Specific guarantees in the Bill of Rights have penumbras, formed by emanations from those guarantees that help give them life and substance. See Poe v. Ullman, 367 U.S. 497, 516-522 (dissenting opinion). Various guarantees create zones of privacy.
Penumbras? Emanations? Life and Substance? Twilight Zones of privacy? For a long time I thought that this was point at which the drugs took affect. Surely such terms can have no meaning in constitutional reasoning. Now the scales fall from my eyes. Mr. Justice Douglas was channeling for mystic dwarfs. Justices Armand, Luis, and Angel co-wrote the opinion.

VI. A. The Daily Judge

Judge with 'spirit pals' is dismissed. "The Supreme Court has dismissed a judge in Malabon who claims to have dwarfs as his 'spirit guides.' [T]he Court said Judge Florentino V. Floro...is unfit to stay on because of his 'medically disabling condition of the mind.'...Examined by Court-appointed doctors, Floro admitted that he believed in 'psychic visions.' He said he had dwarf friends named 'Luis, Armand and Angel.' Floro claimed he could write while in a trance and could be in two places at the same time. He considered himself an 'angel of death' out to punish lawbreakers, especially corrupt court officials...'Psychic phenomena, even assuming [they] exist, have no place in a judiciary...,' the Court said...." More (Manila Times 04.07.2006). Comment. It's good that The Apostle Paul, Martin Luther, and Abraham Lincoln, among others -- all people who at one time or another "suffered" from profoundly-spiritual crises, "hearing voices," etc. -- never wanted to be judges in the Philippines. It's good that a wonderful district court judge I knew back in 1970 didn't let too many people know he prayed to his "spirit pal" (i.e., God) for guidance in difficult cases.

More Idiocy From Around the World
No, this isn't another "aren't Americans funny little things" story (just in case my American friends think I'm picking on them). Instead, this week we're going to laugh at the Philippines.

Trial Court Judge Florentino Floro is up in arms for being dismissed for his beliefs (indeed, he is quoted as saying "They should not have dismissed me for what I believed!"). Is this a case of religious intolerence? Homophobia? Racial hatred?

No, it appears that His Honour was dismissed for claiming to be able to see the future and taking advice from "three mystic dwarves" (who were allegedly called Armand, Luis and Angel). Strangely, it took the Supreme Court three years to decide to get rid of him after hearing of his "methods"...

Still, when you consider some of the doddering old pensioners we have serving as High-Court judges over here, Mr Floro seems positively sane in comparison...

WHERE WILL THE POISONED DWARF STRIKE NEXT?

Not surprisingly the Supreme Court's clinic declared that he was suffering from psychosis, although the court stopped short of calling him raving fucking mad. This comes via the Scotsman.
A judge in the Philippines who claimed he could see into the future and admitted consulting imaginary mystic dwarfs has asked for his Supreme Court job back after being sacked.

This may be the kind of breakthrough in international law that our leftwing looney judges have been waiting for! Imagine the kind of decisions they could arrive at, if only they were allowed to read entrails and cast chicken bones.

Maybe what this former judge needs to do is sit back and wait for an opening on the ninth circus court here in the US. Then, instead of consulting with mystic dwarfs, he can actually collaborate with mental midgets.

STILL CRAZY AFTER ALL THESE WEEKS

A couple of weeks back we learned of a judge in the Philippines who was relieved of his duties after his superiors discovered that the judge believed that he could see into the future and used imaginary dwarf friends to help him render decisions. Last week the judge went in front of Manila’s Supreme Court to plead his case. “They should not have dismissed me for what I believe,” said former judge Florentino Floro. “This is the first time this happened in the Judiciary.” So far, no word on whether the Supreme Court judges will re-instate him, but things don’t look good considering new information which came forth during the hearing, when Floro confessed that he had three dwarf friends named Armand, Luis, and Angel and that he conducted psychic healing sessions in his chamber during breaks. Floro also let it slip that he could inflict pain and sickness on people... good luck! (INQ7.net)

In the News: Judge asks magical dwarves for answers
Filipino fortune-telling judge

Manila, Wednesday May 3: Apparently, a Filipino judge was fired from the Philippines Supreme Court because he frequently consults with three imaginary, magic dwarves. Yes, the dwarves have names: Armand, Luis and Angel.

As Noona so aptly put it, "why us?" Well why not us? In a country where some people believe in incision-less cancer surgery, why not magic dwarves? I'd rather have the magic dwarves than fake cancer surgery any day.

I've said it before, and I'll say it again... them Filipinos be crazy, yo.

Special thanks to Noona for the heads up on this one :)

Well, I think the problem for them is that it was an odd number of dwarves. 3 dwarves + 1 man = 4. You can’t come up with a majority when you have the potential to be 2 for and 2 against. I say if he had FOUR dwarves he would have gotten to keep his job. It only makes sense.

A Philippine judge who claimed he could see into the future and admitted consulting imaginary mystic dwarfs [WHO ARE WE TO SAY THEY WERE IMAGINARY. FASCISTS!] has asked for his job back after being fired by the country's Supreme Court.

"They should not have dismissed me for what I believed," Florentino Floro, a trial judge in the capital's Malabon northern suburb, told reporters after filing his appeal.

He told investigators that three mystic dwarfs -- Armand, Luis and Angel -- helped him carry out healing sessions during breaks in his chambers.

Judge's psychic leanings too over the top
Manila - A Philippines judge who allegedly claimed to have psychic powers and said he had made a covenant with "dwarf friends" has been removed from his post.

Floro, who was said to start his court sessions with a reading from the bible's Book of Revelation, was relieved of his post on administrative grounds but not disbarred or charged with any criminal offence.

"Psychic phenomena, even assuming such exist, have no place in a judiciary duty-bound to apply only positive law," the Supreme Court said.

Judge in Philippines Discriminated Against for Being Psychic
The persecution of the psychically gifted continues. Judge Florentino Floro, who until recently presided over a jurisdiction in suburban Manila, was removed from the bench on "administrative grounds" because of prejudice against those who have the ability to see the future and conduct supernatural healing sessions in chambers. Judge Floro also apparently started each court day with a reading from the Book of Revelations, which is just the kind of thing you want to hear before trying to plead down a traffic ticket.
Judge Floro also said he had made a covenant with "dwarf friends" -- who hasn't? -- and claimed a variety of other supernatural abilities.
The country's Supreme Court ruled that, assuming for the sake of argument that psychic phenomena did exist, they had "no place in a judiciary duty-bound to apply only positive law." The court stressed that Floro was not guilty of any misconduct or corruption, but found that he did have "mental problems" that rendered him "unfit for the delicate task of dispensing justice." For now, maybe, Supreme Court, but when the moon turns blood-red and the Beast with ten heads and seven horns reveals itself, then you guys are really up shit creek without Floro around, that's all I can say.

I previously reported on Judge Florentino Floro, a judge in the Philippines who was removed from the bench recently for acts as innocuous as fortune-telling, faith healing in chambers, and beginning each court session with a cheery reading from the Book of Revelations. He also said he had made a covenant with "dwarf friends," but little was known about these friends until this week.
Floro was back in the news because he is appealing the ruling by the country's Supreme Court removing him from office. The grounds are discrimination against people who tell fortunes, heal people, read from Revelations and make covenants with mystic dwarfs. (Also, he "criticized court procedure," probably the last straw.) "They should not have dismissed me for what I believed," Floro told reporters after filing his appeal.
According to the court, it did not dismiss him for what he believed, it dismissed him for believing something that was nutty. A court-appointed expert found that Floro was suffering from psychosis and the court agreed, partly because of the above and also because of new revelations about the role of the "mystic dwarfs." Of which there were three, named "Armand," "Luis" and "Angel." Their end of the covenant was apparently to help Floro conduct his healing sessions, because as you know faith healing is way more difficult without a mystic dwarf or two around.

FORGIVE AND FORGET......

Everybody is entitled to make mistakes. The voters proved that by electing George W. Bush twice.

To forgive is a Godly thing to do. Forgive and forget. But the Geezer has a hard time doing it for the viewers of all the reality shows on TV. In the words of that great American Cardinal Mahoney….”Feh”!

I must confess to having made some mistakes in the past. Some real whoppers. For instance I urged most of my friends to put all their money into WorldCom; I voted for former Congressman “Duke” Cunningham for sainthood; and I swore in court that I was stuck in an elevator for 6-hours with Dick Cheney on speed.

A judge in the Philippines was fired by the country’s Supreme Court just because he claimed he could see into the future and admitted consulting imaginary mystic dwarfs. Guess they never heard about forgiving mistakes. “They should not have dismissed me for what I believed,” Judge Floro told reporters after filing his appeal. Floro was sacked last month and fined $780 after a three-year investigation found he was incompetent – if that’s grounds for dismissal than most of the judges in American courts would be standing on the unemployment line.

He was also charged with bias in a case he was trying when he asked a young, sexy defendant to sit on his lap when testifying. He told investigators that three mystic dwarfs – Armand, Luis and Angel (first cousins to Manny, Moe and Jack) helped him carrying out healing sessions during breaks in his chambers. During one “healing session” he diagnosed someone as having ague fever, shin splints, rickets and black hairy tongue disease when they actually had a bad case of hemorrhoids.

The Supreme Court said it was not within its expertise to conclude that Floro was insane, but agreed with the court’s clinic’s finding that he was suffering from psychosis. If he is not forgiven his mistakes he has decided to run for the Presidency of the Philippines. After what happened in the U.S. of A. in 2000 and 2004 I wouldn’t bet against him.

A judge on the Supreme Court of the Philippines was fired
recently for claiming he could see into the future and for
admitting he consulted imaginary mystic dwarfs. Students
of jurisprudence here in the U. S. say these views are not all
that different from those espoused by Justice Antonin Scalia,
except that he claims he can see into the past.

Fortune telling judge couldn't see the future; Reuters can't spell "dwarves"
"A Philippine judge who claimed he could see into the future and admitted consulting imaginary mystic dwarfs [sic] has asked for his job back after being fired by the country's Supreme Court."

***
Maybe Reuters will start calling terrorists "vreedom vighters" now. In related news, the Mop & Pail thinks 1986 was "ten years ago"!

UPDATE: reader Stephen writes:
"Dwarves" was a deliberate misspelling of the word introduced by Tolkien in THE HOBBIT to refer specifically to his imaginary fantasy race.

When the word is used in a generic or non-specific sense the proper plural *is* "dwarfs", the adjectival form is "dwarfish", etc.

One of those many marvelous inconsistencies in English....

Just to let you know so you can amend the post before other less generous souls start bashing you for it.

Talking to Garden Gnomes

Hi All, Welcome back to SilverHorn Lodge, nestled on the shore of Silverhorn Lake, high atop Silverhorn Mountain. If my typing is a little off, I apologize but I am covered in Croc Bloc and it's making my fingers a little slipperly. However, I haven't seen a crocodile all afternoon.

I hope everyone has had a chance to review the list of contents from the Silverhorn Emergency Kit and you are making your own now, be prepared, several natural disasters are just around the corner, and if they don't happen you'll have a neat box of fun stuff to play with. I gotta tell ya, if you play Milli Vanilli enough, it grows on ya. I think they are going to be big someday!

My team of Silverhorn Mountain Lodge Financial Advisors are currently considering marketing our own emergency kits. If we do, we will make them available to all our paid up members at a deep discount. We care about you and want you prepared and ready for any eventuality.

A Silverhorn Mountain visit is never complete without a comment on something in the news, so here is something I came across today. A Supreme Court judge from the Philippines, (I didn't even know there was such a place as the Philippines anymore) has been fired and fined a bunch of Philippine money for conduct unbecoming a judge. What did he do you ask? not much, he was caught talking to garden gnomes. It's amazing what some people will do, apparently the poor old judge so enjoyed his discussions with the garden gnomes he brought them in to court and appointed them as his advisors.

Armand, Luis and Angel are the three garden gnomes who had been providing the now
ex- Supreme Court Judge with guidance. Apparently, the government in Manila discovered that the gnomes were pretty bright, so they fired the judge and appointed the gnomes to the bench.

We have a few garden gnomes around Silverhorn Lodge. I brought them home from the hardware store a couple of years ago. The clerk assured me they were good workers around a garden, however, I disagree, all I ever see the little fellas do is stand around. But like the judge, most of the time I find their advice as helpful as the advice I get from real people. An evening on the back porch of the Lodge with our gnomes is usually thought provoking, if not profound. It is often entertaining, especially if Marcello plays his guitar and sings.

I have found them to be pleasant to have around, especially when I am in need of someone to talk to, they are very good listeners, although one of them, Carlos, sometimes gets a little wound up and he is a little too opinionated for me. Don't ask him about the war in Iraq, or cinch bugs.

Alonzo, on the other hand, is very quiet, he is my favorite, but I have banished him to the far side of the backyard, facing the forest. He used to be on the front walk of the Lodge, but he got caught looking up the dress of one of our female guests and I had to put him out back. He claimed it was because his is only 22 inches tall and his head is permanently cemented in an upward looking direction. Nonetheless, I had no choice but to move him, the guest was threatening legal action.

I have to admit that on occasion, I have incorporated some of what Alonzo, Carlos and Marcello tell me in these stories. I wasn't aware that talking to them was a crime, I'll have to be a little more careful when I take them to the store for an ice cream.

On another note, our financial folks have turned their skills to marketing now because poor weather is slowing down the tourist trade here on the mountain so we are taking the mountain to them. Online auctions are the chosen route and most of my stuff is flying off the shelves. I only have one pair of shoes left. It's amazing what will sell on the internet. They offered me a job in distribution and shipping, but I declined their offer because I am much too busy keeping you all informed with the goings on around here. Besides I am making money from this, since the first Silverhorn story hit the world wide web, I have accrued $7.22 in ad revenue. I only need another $92.78 and the ad company will be sending me a cheque.

I'm sorry but I have to cut this a little short, apparently Alonzo has snuck into the house and my wife just found him in her underwear drawer, she is mad as hell and talking about selling him on the internet, I have to rescue him before she does, because he tells the best stories of all three of them!!

Whether it’s crucifixion reenactments or judges consulting mystic gnomes, there’s some whacky stuff going on over in the Philippines. Not to judge the entire country based on the actions of a few nuts, but there must be something in the water over there (although there seem to be plenty of people drinking the same water here).
MANILA (Reuters) - A Philippine judge who claimed he could see into the future and admitted consulting imaginary mystic dwarfs has asked for his job back after being fired by the country’s Supreme Court.

I think part of the problem was the dwards themselves. Armand has a proven track record and Luis is pretty reliable, but Angel is another story. The judge most likely got fired because he was consulting a dwarf whose name carries a religious connotation. This is just another example of a man being fired for expressing his faith. Or because he’s crazy, although the court points out they’re not qualified to make that decision.

This reminds me of the time I got suspended for hanging out behind the high school with Doc, Sneezy, Happy and Dopey. They slapped me with some kinda trumped up drug charge and told me I was hallucinating. I successfully sued the school for discriminating against my beliefs. Later that year, a bunch of us staged a walkout in protest of the fact that our head coach refused to allow our magic ass gremlins to join the track team. Goddamn secularists.

Reminds me of the time my boss wouldn’t give me an extra long lunch break to commune with the spirit world. He told me I had to fit it in the confines of my 30 minute lunch break or two 10 minute breaks. I told him that sometimes the spirits took a while to respond and that the number of non-believers at work were impeding my contact. I got him and half the staff fired for discriminating against my beliefs.

No difference at all, Star. Luckily, one doesn’t *have* to swear on a bibble in court anymore, but I would love to one day be called to testify in a trial I could give a fuck about.
Since Muslims are making moves to have Q’urans stocked in courtrooms so they can swear on them rather than bibbles, and the whole idea is to just make you swear on something you deeply believe in so as to further guarantee you keep your oath of truth, I would love an opportunity to insist that I be allowed to swear on the book I believe in most: Everyone Poops
A more thoroughly truth-telling book has never been written, and I would insist on swearing on it. In fact, I believe that magic gremlins live in my ass and guide my destiny — and they insist I swear on Everyone Poops. They tell me this when I pray to them. Or at least, a guy named Hankey (who told me about the magic gremlins) says they do. Mister Hankey, he likes to be called. And he says if I don’t pray to the magic ass gremlins, he’ll kick the shit out of me.
I don’t care how ridiculous that sounds to you. It is the basis of my entire scatotheology.
What’s that you say? There are no magic gremlins in my ass? Prove it! You are discriminating against my deeply held beliefs!
I’m filing a civil suit as soon as I find a lawyer!
Are there any lawyers in the room???

True, but Little Red Riding Hood has already threatened to file a perpetual restraining order against him if he gets out, and she’s hired the Hunter as her full-time bodyguard. This is fun! Filipinos are a blast, aren’t they? No wonder the sane ones leave.

My wife is an immigrant from the Philippines, and I love her family, but there is a lot of whackiness in the country. This is a country that elected a former actor and incompetent (Joseph Estrada) for president (I know some people are going to bring up Reagan, but c’mon, even if you disagreed with his policies, he had political experience before being elected president) and nearly electing another former actor and incompetent (Fernando Poe, who died less than a year after the election, so it was probably a good thing he did not win).
There is a lot of poverty and desperation in the Philippines, and the masses get fed up when they don’t see the professional politicians like Arroyo delivering for them, so they look to charismatic populist figures who talk a good talk but don’t have a friggin clue about how to govern a populous and sprawling archipelago.

A judge in a Philippines court just got canned after he ran around telling anyone willing to listen that he was capable of seeing into the future. He also claimed that he consulted imaginary mystic dwarfs when issuing verdicts. "They should not have dismissed me for what I believed," Florentino Floro, a trial judge in the capital's Malabon northern suburb, told reporters after filing his appeal. Now I mention all this because many American court decisions are also decided by mystic dwarfs, called jurors. And unlike the dwarfs in the Filipino court, the ones in America, and especially the ones in that Alexandria, Virginia court that just decided NOT to give the death penalty to arch-terrorist Zacarias Moussaoui, are obviously incapable of seeing into the future.

So let us help them out. By keeping Zacarias Moussaoui locked up, well fed, and spending his days watching movies, the midget jurors are endangering hundreds of American lives. They are creating incentives for al-Qaeda and its affiliates to grab planes, trains, and embassies full of Americans, hold them at bayonet point or whisk them off to friendly places, and threaten to murder them unless their well-fed comrade in the federal pen is released. "America, you lost . . . I won," Moussaoui declared as he was being led away from the court.

Of course, when that happens the US can always send Jimmy Carter and Bill Clinton to negotiate their release . . .

I'm afraid I have to agree. Perhaps the more intelligent religionists out there can explain this to me, but if this were to happen in America, and the three mystic beings he consulted were named Father, Son and Holy Ghost instead of Moe, Larry and Curly or whatever, half the country would be in an uproar. How DARE his religious beliefs be criticized?
Ala James Randi and his million-dollar prize, I'm awarding a million-eyeroll prize to the religionist who can explain to me in rational, logical terms why THEIR religion is correct but THIS guy is insane.

Indeed, wasn't Governor Pawlenty's wife a judge, and wasn't there some concern with her turning to prayer as a method of deciding cases? My memory may be off (particularly since I wasn't in MN at the time), but I do seem to recall some such thing.

Actually, his belief in these magical dwarves doesn't make him as unqualified as a religious person, IMO.
His belief is a strike against him, a sign of poor judgement at least as it regards supernatural beings of small stature... and clearly he has a mental illness. But *I* have a mental illness - and some of the people I met in psych wards had fairly good judgement... one man who was schizophrenic is a particular example.
Not ideal candidates, but then religious believers are worse, because they not only show the same poor judgement in regard to supernatural things, but for some it's "easier" to be religious, because it's so popular - so many others are religious. That shows even worse judgement - the ability to be easily swayed to illogical conclusions.
Ya gotta give this guy the edge... but maybe he should have to recuse himself if Rumplestiltskin ever comes up in front of him.

Finally, and on top of all these REPORTS worldwide, the ABS-CBN, Channel 2 management selected and VOTED Judge Floro / the Decision in its ANNIVERSARY PRESENTATION “KONTROBERSYAL” topic of DISKRIMINASYON: “Psychic Judge” (2 gaps or full segments, 30 mintues) with Host Mr. Boy ABUNDA, on May 12, 2006/Friday, late night, 12:30 a.m. Saturday (and watched worldwide via satellite, specifically, in the TFC, USA (The Filipino Channel; REPLAYED at 4:00 a.m. and 5:00 a.m. on May 13 and 14, 2006);
27. Such being VOTED upon is equivalent to being the KONTROBERSYAL of the Year; we beg leave that judicial notice be taken, to prove that such TELEVISION Documentary is a GREAT HONOR for a PERSONA, a Judge, a Jurist, and the fact that he was “MADE”;
VCD copy of the May 12, 2006 KONTROBERSYAL is attached as part hereof (of the ORIGINAL, only) NEXT PAGE.
5th Letter to Chief Justice Artemio V. Panganiban,

May 5/First Friday, 2006

Chief Justice Artemio V. Panganiban,
SUPREME COURT, Manila

Dear Chief Justice Panganiban,
Last week, I personally gave copy of my 81 pages Motion for Partial Reconsideration to PIO Chief, Atty. Ismael Khan. I asked him to tell you that: “LUBOS po akong nagpapasalamat kay C.J. Panganiban at sa 21st Court, dahil sa pinangako niyang ZERO BACKLOG of cases and CIDA or ACID (as he stated before the Nation and Korina Sanchez on 21 December, 2005)”. Atty. Khan told me to put in writing my gesture of GRATITUTE and FAITH, thus, this Letter plus --- I told him that I already WROTE the Chief Justice, thanking him and the 21st Court for deciding my 6 ¾ years case (in my April 21, 2006 Motion for Partial Reconsideration, 7 pages).
You stated in your speech at GUAGUA, that:
“No Pain, No Gain

Let me give you a simple example. A few days ago, my nine-year old grandson Miggy -- that's his name -- proudly approached me and showed me a certificate attesting to his getting "first honors" in grade three at Southridge School. I, of course, hugged and congratulated him. I also called up his mother (who is my daughter) to congratulate her for having such a brilliant son. And I asked Miggy, "Why do you think you were able to achieve such high honors in class?"
"Well, Lolo," he replied, "It is because I studied hard. Instead of watching television at night, I did my homework; instead of sleeping late in the mornings, I woke up early to be able to go to school on time; and instead of playing all day, I read my lessons and prepared for my tests."
Dear graduates, after these graduation ceremonies and family celebrations, you will once more face the real world and its challenges. Indeed, your new life as a graduate may be beset with obstacles. But do not lose heart. Simply hang on, resolve to do better and work even harder.
My own life experiences attest to this truism: There is no triumph without trial, no victory without a battle. In fact, the more difficult the trial, the sweeter the triumph and the more bruising the battle, the greater the victory.

Yes, ladies and gentlemen, in all my struggles and trials God has never abandoned me. Neither will He forget any one of you. Sometimes we may, in our desperation, feel that He has forgotten because He does not manifest Himself to us. But let me assure you that He is always present among us. He will always answer our prayers in His own way and in His own time. He is the silent listener to every conversation and witness to everything we do. He is above us, below us, around us, within us, in our hearts and our spirits -- guiding us, inspiring us, helping us, and leading us to the everlasting Kingdom.
Friends and graduates, our whole life is a recurring cycle of sacrifice and success; of trial and triumph; of misery and joy and of crucifixion and resurrection. We cannot achieve success if we are not willing to work and to sacrifice; we cannot triumph unless we face trials and we cannot find joy unless we know misery. Such is life: no study, no graduation; no work, no pay; no pain, no gain.
Graduates, ladies and gentlemen, if my presence here today is to have any meaning, I hope that you will always remember my little message, which I will now summarize in three points: xxx.

2. There can be no success without sacrifice, triumph without trial, or resurrection without crucifixion.
3. God is always with us, around us, within us, and will never ever abandon us.
In short, where there is no pain, there will be no gain.
I thank you.”

[Commencement address delivered by Justice Panganiban during the College Commencement Exercises of the Angeles University Foundation on April 17, 1999, and the Guagua National Colleges on March 24, 1999].

I always quoted this speech in my writings, because I feel that it came from your heart, and for me, it is the most beautiful speech, you ever wrote. I took pains in reproducing in this long motion, all the REPORTS worldwide regarding myself and the DECISION.

Fr. Bernas, S.J. opined that the 338 pages JAVELLANA vs. SECRETARY, 1973 RATIFICATION case is the hardest and longest in P.I. judicial history. His belief remains true, with due respect, until April 6, 2006, when Atty. Ma. Luisa Villarama released the DECISION in this case. I beg leave, therefore, that your 21st Court, take judicial NOTICE that no S.C. Decision since 1901 was REPORTED with greaterer magnitude INTERNATIONALLY (and locally), than the instant Minita Viray Chico-Narario Ponencia. HISTORY therefore has fairly JUDGED me and this Decision.

PREMISES CONSIDERED, I beg the indulgence of your highest Office, and your good self, as Primus inter Pares, to BENIGNLY look upon my case and partial appeal: so that the PONENTE and the Members of this 21st Court would take a compassionate STUDY of the 7 points or GROUNDS I raised. In my 81 pages Supplemental Motion for Partial Reconsideration, I complained that I was denied due process of law and my primary cardinal rights guaranteed by ANG TIBAY were utterly violated by the Investigator, the Investigation and the 6 mental health professionals. Please, I beg, that with your MORAL ASCENDANCY, I humbly petition that your good/highest Office direct the PONENTE (tasked or assigned to study this case under the Constitution, after all of you voted and deliberated on my FATE and DESTINY) to RE-EXAMINE by taking a very benevolent SECOND LOOK upon the following 7 grounds, I hereunder REPRODUCE (from my filed 81 pages aforementioned appeal), based on your predecessor’s ponencia in SORIA vs VILLEGAS, that regarding judges and court personnel, even a third motion for reconsideration is allowed:
I.

The Intent of the Framers of the 1987 Constitution (1 Record 443, 495-6, and 1 Journal 237 of the 1986 Constitutional Commission, specifically, the Constitutional Convention’s Mr. Concepcion & Fr. Bernas, S.J.) is: The power to determine the incapacity of judges to discharge the duties of their office is part of the overall administrative authority of the Supreme Court over all its members and all the members of the judiciary. It can only declare ‘the incapacity of a judge’ (under Sec. 11, Art. VIII,Constitution) by creating a panel of impartial (private) doctors-specialists in the field.

Ms. Francianina G. Sanchez, Clinical Psychologist and Chief Judicial Staff Officer, Psychologist Ms. Beatriz O. Cruz Dr. Celeste P. Vista, M.D. (Psychiatrist and Medical Officer IV), and Supreme Court Senior Chief Staff Officer, general practitioner and government physician Dr. Rosa J. Mendoza, M.D. who conducted the mental tests on Judge Floro (on December 15, 2000) are absolutely disqualified by the Constitutional provision; and their March 7, 2001 psychological/psychiatric evalulation reports are NULL and VOID ab initio/inadmissible for any legal purpose.

Constitutional Weight and Value of the September, 1998 JBC En Banc Final VOTE, Nomination and Presidential Appointment of Judge Floro upon the Issue of his Mental Fitness as Judge vis-à-vis the OCA’s Resurrection of the Issue in its Judicial Audit (Requested by Judge Floro) Memorandum-Complaint Report of July, 1999 without any Private Complainant and without any Sworn Complaint.
II.

Without the complainant, OCA’s presenting the 6 mental health professionals --- Dr. Cecilia Villegas and Ms. Melinda Grio, 1995 & Dr. Celeste Vista, Ms. Beatriz Cruz, (I.Q. 68 of Judge Floro) Ms. Francianina G. Sanchez, 1998, 2001, and general physician Dr. Rosa J. Mendoza, M.D. --- their questioned (evaluation) report on Judge Floro, aside from being grossly incomplete and inadequate, is HEARSAY evidence.

Judge Floro is entitled to cross-examine said mental health professional who made the report. Without such examination, he would be deprived of the right to confront and examine the witnesses against him.

The Investigator (Ret.) Justice Pedro A. Ramirez’s repeated denials of (1) Judge Floro’s Continuing Trial Objections and (2) December 5, 2000, September 28, October 9, 2001 & February 21, 2002 Omnibus Motions to a) put on the witness stand, to confront and to determine their qualifications as experts b) to cross-examine and c) to disqualify or inhibit, the said 6 mental health professionals, violated the cardinal primary rights of Judge Floro (Ang Tibay vs. CIR) to administrative, substantive and constitutional due process of law; it is no less than denial of justice; such denial suffices to cast on the investigation, official acts and the mental reports the impress of nullity.

Utter failure of the complainant OCA to a) present said mental health professionals as witnesses, b) to mark and offer in evidence their mental evaluation reports as demanded in writing (motions and continuing objections at the trial) by Judge Floro, is tantamount to SUPPRESSION of EVIDENCE (under the 1989 Rules on Evidence).

III.
Judge Floro’s cardinal primary rights --- “2. the tribunal must consider the evidence presented; 3. the decision must have something to support itself; 4. the evidence must be substantial 5. the decision must be based on the evidence presented at the hearing” ---were flagrantly violated by the Investigator (Ret.) Justice Ramirez’s March 7, 2001 Partial Confidential Report: it blatantly discarded, excluded, and failed to consider the testimonies and opinions of all his ordinary witnesses.
Under Sec. 50 (c), Rule 130, Rules on Evidence, Judge Floro’s ordinary witnesses proved by unrebutted, clear, convincing and straightforward testimonies/opinions (excluded by J. Ramirez’s Report and Conclusions) his medical and mental capacity / fitness to sit as RTC Judge
III. A.
Under Sec. 50 (c), Rule 130, Rules on Evidence, Judge Floro’s ordinary witnesses --- a) RTC Malabon Court Officers --- Fiscal Pacifico Flores, Fiscal Neptali Aliposa, PAO Lawyer Erwin Gallevo, Legal Researcher Aina Talag Pascual and NCR/RTC Judge Edmundo T. Acuna (former Malabon Fiscal), Atty. Arsenio Reyes (Malabon Lawyer), and b) Judge Floro’s neighbors/townmates Jocelyn Fernandez, Belen Gomez, Asuncion Borjal, Jovita Estrella, Dr. Ma. Nieves Celeste, M.D., & Danilo Cuarto --- proved by unrebutted, clear, convincing and straightforward testimonies/opinions (excluded by J. Ramirez’s Report and Conclusions) his medical and mental capacity / fitness to sit as RTC Judge. Their opinions refuted, traversed and nullified the lies, fabrications and falsehood offered by the OCA’s witness Judge Aquino,Jr., inter alia.
III. B.
Judge Floro’s cardinal primary rights --- “2. the tribunal must consider the evidence presented; 3. the decision must have something to support itself; 4. the evidence must be substantial 5. the decision must be based on the evidence presented at the hearing” --- were flagrantly violated by the Investigator (Ret.) Justice Ramirez’s March 7, 2001 Partial Confidential Report: it blatantly discarded, excluded, and failed to consider the expert testimony and opinion of Mr. JAIME T. LICAUCO, a parapsychologist and Visiting Faculty Member of the Rosebridge Graduate School of Integrative PSYCHOLOGY in Concord, California.
III. C.
Expert witness Mr. JAIME T. LICAUCO [a parapsychologist and Visiting Faculty Member of the Rosebridge Graduate School of Integrative PSYCHOLOGY in Concord, California] testified that: a) (Ret.) Justices Flerida Ruth Romero (Member of the Theosophical Society) and Jesus Elbinias believed and practiced PSYCHIC PHENOMENA during their incumbency, b) DWARVES exist and can be proved by scientific methods, c) Judge Floro’s authentic healing was duly investigated and proved, d) Judge Floro’s belief in Psychic Phenomena as GIFTED is not abnormal but paranormal, and e) trance and by location can be proved.
IV.
Judge Floro’s cardinal primary rights --- “2. the tribunal must consider the evidence presented; 3. the decision must have something to support itself; 4. the evidence must be substantial 5. the decision must be based on the evidence presented at the hearing” --- were flagrantly violated by the Investigator (Ret.) Justice Ramirez: In bad faith, with bias and partiality, J. Ramirez a) denied all the Continuing Objections of Judge Floro at the trials, he blatantly discarded, excluded, and failed to consider practically all of Judge Floro’s ADMITTED EXHIBITS 1 – 67/sub-markings.

The Investigator (Ret.) Justice Ramirez in bad faith, with bias and partiality, threw the Blue Temporary ROLLO and a Ballpen to/towards Judge Floro at a hearing. He warned and punished Judge Floro, as he said in the TSN: he intentionally OMITTED and failed to file the required (by Sec. 5, Rule 140, Rules of Court) REPORT and RECOMMENDATION (due on May, 2001) in the 2 consolidated administrative cases (A.M. NO. 99-7-273-RTC & A.M. NO. RTJ-06-1988, ARRIEGO case, Formerly A.M. OCA IPI No. 99-812-RTJ) so that Judge Floro’s case would not be decided and so that his suspension would be prolonged indefinitely.
VI .
Judge Floro’s expert witnesses – Psychiatrists Dr. Eduardo L. Jurilla, Dr. Eduardo T. Maaba & psychologist Rowena A. Reyes --- certified and testified on their testimonies in chief that Judge Floro is mentally fit to sit as Judge. Their expert testimonies are IMPECCABLE.
Judge Floro TIMELY registered CONTINUING OBJECTIONS to the improper / inadmissible cross-examination questions a) regarding the field of Psychic Phenomena (which field is not the expertise of the witnesses on Psychiatry and Psychology), and b) regarding assumptions not warranted by the evidence.

The Investigator (Ret.) J. Ramirez in bad faith, with bias and partiality blatantly discarded, excluded, and failed to consider their expert testimonies as a whole; he merely selected the negative portions of the cross-examination, forgetting that the lone OCA witness, Judge Aquino, Jr. miserably failed to IMPEACH the expert witnesses/testimonies.

All the expert witnesses of Judge Floro NEVER testified on cross-examination that Judge Floro is unfit to sit as Judge. On the contrary, Dr. Maaba specifically testified that Judge Floro is not psychotic, not insane, since his belief in dwarves and the paranormal are not abnormal but CULTURE-ORIENTED; while Dr. Jurilla and Ms. Reyes stressed that they do not know Psychic Phenomena; nowhere in their cross-examination can be found any testimony that says – Judge Floro is unfit to sit as Judge.
VI. A.
Judge Floro, his family and mild retarded brother Robert V. Floro have no defective genes (regarding mental disease). Robert V. Floro’s mild mental retardation (according to Cupertino Psychiatrist’s Records) was due to wrong medicine given to his mother during pregnancy.
There is / was no medical proof whatsoever presented, that mental retardation can be inherited. To punish Judge Floro because of wrong medicine is cruel and unusual punishment banned by the Constitution.
VII.

The Fundamental Law forbids punishment for professing religious beliefs. Judge Floro, with due respect, cannot be relieved from office due to his religious beliefs in dwarves, angel of death, the gifts of the Holy Spirit --- prophecy and spiritual healing --- and the paranormal or “the spiritual”.
“No person can be punished for entertaining or professing
religious beliefs or disbeliefs.”

Justice HUGO BLACK

Everson v. Board of Education, 330 U.S. 1 (1947).

“No man may be punished for what he thinks. Cogitationis,
poenam, nemo emeret.”

With my fighting FAITH in your stewardship, I therefore leave my DESTINY in your hands, in your powerful pen. God’s ways are not ours. His ways as you wrote is: “He will always answer our prayers in His own way and in His own time. He is the silent listener to every conversation and witness to everything we do.”

KONTROBERSYAL: “Psychic Judge”
[ANNIVERSARY PRESENTATION, 2 GAPS / SEGMENTS, 30 minutes, ABS-CBN, Ch.2, ANC Cable & TFC (The Filipino Channel, U.S.A), May 12, 2006, late night edition, after the INSIDER, = 12:30 a.m. Saturday, with REPLAY on ANC Cable, 4:00 a.m. & 5:00 a.m., May 13 & 14, respectively].

TRANSCRIPT

Boy Abunda : Ako po si Boy Abunda at ito ang KONTROBERSYAL.

“Ano ang iyong paniniwala?”

“Paano kung husgahan ka sa iyong nakikita at paniniwala?”

Boy Abunda : Ngayong gabi --- Judge sinibak dahil kumukunsulta di
umano sa mga duwende.

Judge Floro : Ako raw ay insane because I believe in dwarfs, angel of death, inflicting sickness; it is weird and grandiose for a judge who displays in his sala a written prediction that Erap will not finish his term.

because I believe in dwarfs, angel of death, inflicting
sickness, not only on court personnel, but on those who
commit graft and corruption, plus yung…..

Malabon Regional Trial Court Branch 73 noong 1998.

Judge Floro : A judge can be a …Relieved o removed from service due to or in view of incapacity; ngayon, ano ang ibig sabihin ng incapacity?
Diniscuss nung July 14, 1986 yan ni Fr Joaquin Bernas ano ang ibig sabihin ng incapacity, “por ehemplo”, 67 years old na Justice naguulyanin na, pano natin malalaman, siya ba ang magsasabi? Hindi, sabi ni Commissioner Concepcion --- kailangan “ika” follow the court practice --- there must be a panel of doctors meaning a committee of doctors na mag-rereview at ang Supreme Court eh titignan.
and Bar Council “en banc”, nagbotohan sila , natalo
yung dalawang member at nanalo at nabreak yung tie ni
Chief Justice Narvasa, so final and executory
nanominate ako; ngayon niresurrect nila yung issue.
Gusto nila uli sila ang magtest, so tumutol ako.

kanila. Ngayon….

Boy Abunda : And then what happened?
Judge Floro :Ngayon kumuha ako ng test, binigyan din ako ng failing mark kasi naniniwala raw ako sa dwende, sa angel of death, inflicting sickness, sa prophecy and healing, eh
sabi ko these are spiritual beliefs.
Paul sa korinto na “The gift from the Holy Spirit” so
kaloob sa tagalong; hindi lang pwedeng gamutin kasi yung 85% na nasa medical dictionary na tinatawag na
incurable diseases like nerve disorders, cancer stage 4 and
Jaime Licauco : I gathered a group of people about 12 or so, 15, a small
number. Some are office or former office mates…ganyan,
who have some problems and had him apply his hands
on the affected area, and then I interviewed them
afterwards noh. Well they experienced extreme heat coz
I also experienced that din. He tried his hands also on me
and talagang merong heat. I mean not ordinary heat that
you would normally associate with temperature…higher
than that, and this is normally the type of temperature
that healers have when they are doing healing, and after this I interviewed people with their … and I would say that….out of the 15 of them…. ten to twelve people experienced really relief and the rest of the ailment siguro mga 3 to 5 or so, did not experience anything at all which is quite again the average, dramatic average, quite high.

Boy Abunda : Pero totoo man o hindi ang mga kakayahan at nakikita ni
Judge Floro, iba pa rin ang tingin ng karamihan sa mga
katulad niya.
Interviewee # 1 : Parang, Abnormal o something.
Q : Bakit?
A : Kasi parang, parang, sa ngayon wala na siguro
ganyan diba?
Interviewee # 2 : Imagination lang po kasi nila yun eh!
Interviewee # 3 : Parang malalim, profound siyang tao.
the so called educated people, iba ang tingin diyan sa mga
ganyan hindi ito pinaniniwalaan, but I have talked to
people who are highly educated, one of it is a former
mayor, others are educators, another lawyer who actually saw and talked to duwendes, and there are even priests and nuns I have talked to, who actually have seen and anybody who exhibits knowledge that are not, and that is not common is suspect noh…as far as the orthodox or the mainstream, science is concern.
Boy Abunda : Pinaliwanag naman ni Dra. Imelda Villar isang psycho

Dra. Imelda Villar : I think there are some paranormal phenomena, but there
are also some people whose imaginations are very, very
fertile.
A : Ah oo, because I predicted in writing, displaying in the
court room my written prediction ah, 4 x 4.
Q : Sa, sala nyo po?
A : Opo sa sala, that Erap will be the 13th unlucky president
who will not finish his term.
Q : Ah, isinulat nyo po ito at ipinaskil nyo po ito sa inyong
Sala sa inyong courtroom, pano ang pagkakapaskil po,
was it in a form of a poster? Was it a form….
A : No!
Q : A banner?
A : Kasi may picture si Erap at saka ako nag-ooathtaking ako noon sa kanya.
Boy Abunda : Okay, okay.

Q : Never in your career as a judge na naaapektuhan ang
iyong cold and impartial delivery of justice?
A : Lahat ng desisyon ko, interlocatory orders and resolutions
--- based on foreign and local authorities, at ako lang ang
iba pang public office.
Judge Floro : Sinabi nila na ako raw ay napakataas ng academic
achievements ko, ah yung IQ ko, yung mga ganun, ah
ibig sabihin … kaya nirerecommend ako sa ibang parte ng….
Boy Abunda : Branches of Government.
Judge Floro : Branches of Government, na hindi nagdidispense ng
justice.
Boy Abunda : Ah okay.
Judge Floro : For example Labor Arbiter, Court of tax appeals.

Jaime Licauco : The media I think, ah coverage at least noh? Has not
presented him as he really is, but you know the guy is so mentally honest that he does not want to hide, kung ano siya , what you see is what you get….
“we are punished not by what we believed in but what
we do or failed to do.”
Boy Abunda : Long years of hard work bilang law student, abugado at
huwes, patuloy na umaasa si Judge Floro na maibabalik
siya sa pwesto at ipaglalaban ang kanyang mga
paniniwala

Making fun of believers everywhere. This is an atheist site. It’s an atheist site that rants about encroaching theocracy, evil done from religion, and religious hypocrisy, stupidity, and irrationality. That doesn’t mean Xians or other religious folks can’t or don’t make worthwhile contributions to our discussion (we have some regular theistic commenters who make real positive contributions to the discussions); but it does mean that stopping in to witness for Jeebus, telling us how sorry you are for us, offering us another lame-ass attempt at Pascal’s Wager or a Free Will theodicy, or threatening us with the burning fires of hell is the moral equivalent of spam, and will be treated as such.

56. Philippine judge dismissed for consulting “imaginary mystic dwarfs”

Plus Ultra, May 4, 2006, 5:06 a.m., under News, Weird/Extreme, Secret Societies/Occult, from REUTERS, www.plusultra.blog.com This blog, Plus Ultra, was started in September 2005, by the owners of Dragon Key Press, the same people who once brought you Dagobert’s Revenge Magazine. This was a print publication which ran from 1996 to 2003, and which focused on the now-familiar subjects of the Holy Grail, the Priory of Sion, the Merovingian bloodline, and Rennes-le-Chateau. Of course, when we were publishing Dagobert’s Revenge these subjects were much more obscure than they are now, thanks to novelist Dan Brown. So that is why we created Plus Ultra. The name implies the “no-holds-barred” nature of what we do. “Plus Ultra”, meaning “There is more beyond”, was a phrase originally associated with the Europeans who explored the New World, beyond the Pillars of Hercules that were once believed to mark the boundaries of the world’s navigable waters. But I have found that it is impossible to please everybody, and usually, it is impossible to please anybody. So why bother. We should just use this blog to explore the areas that interest us, without fear, and without any sense of obligation.- Tracy R. Twyman, Editor, Plus Ultra

Some blogs are highly influential and have enormous readership while others are primarily intended for a close circle of family and friends. The power of weblogs is that they allow millions of people to easily publish their ideas, and millions more to comment on them.
